TOBACCO ACT

 (Cap. 65:02)

TOBACCO (EXPORT) (AMENDMENT) REGULATIONS, 2010

 

In Exercise of the powers conferred by section 36 of the Tobacco Act, I, Professor Peter Mwanza, Minister of Agriculture and Food Security, make the following Regulations—

  1. These Regulations may be cited as the Tobacco (Export) (Amendment) Regulations, 2010.
  2. Regulation 2 of the Tobacco (Export) Regulation is revoked and replaced with the following new reguation—

2.—(1) No person shall export any type of tobacco grown or produced in Malawi or tobacco sold over the auction floors in any year unless he is in possession of an export permit issued under the Control of Goods Act.

(2) The Minister shall publish a notice in the Gazette requesting persons to apply for export licences in accordance with    the provision of the Control of Goods Act.

(3) Any person who exports tobacco in contravention of sub-regulation (1) commits an offence of smuggling and shall be liable on conviction, to a fine of two thousand Kwacha (K2,000) and to imprisonment for six (6) months, and the tobacco shall be forfeited to the Malawi Government

(4) For the purposes of this regulation, “smuggling” includes illegal exportation and movement of tobacco across the territory of Malawi.”.
