TOBACCO (CONTROL OF MOVEMENT) (AMENDMENT)
REGULATIONS, 2010
In Exercise of the powers conferred by section 36 of the Tobacco Act, I, Professor Peter Mwanza, Minister of Agriculture and Food Security, make the following Regulations—
1. These Regulations may be cited as the Tobacco (Control of citation Movement) (Amendment) Regulations, 2010.
2. The Tobacco (Control of Movement”) Regulations (hereinafter referred to as the “principal Regulations”) are amended, by deleting regulation 2 and substituting therefor the following regulation as regulation 2—
2. No tobacco shall be moved within Malawi between the hours of sunset and sunrise except when such tobacco is moved—
(a) for the purposes of sale at auction floors licensed under this Act or for the purposes of sale to a person licensed to buy and resell tobacco under this Act; or
(b) by a person licensed to grow and sell or to buy and resell tobacco.”.
3. Regulation 3 of the principal Regulations is revoked and replaced with the following new regulation—
3. Any person, tobacco transporter or carrier who is found moving, transporting or otherwise taking away tobacco outside the prescribed hours in contravention of regulation 2 commits an offence and on conviction, shall be liable to a fine of two thousand Kwacha (K2,000) and to imprisonment for six (6) months, and the tobacco shall be forfeited to the Malawi Government.”.
